These Terms of Use (“Terms”) govern your access to and use of the websites, applications, and platform operated under the brand Crea Services (the “Service”). By creating an account, accessing, or using the Service, you agree to these Terms. If you are using the Service on behalf of an organisation, you represent that you have authority to bind that organisation. These Terms are a detailed template; have them reviewed by legal counsel and aligned with your commercial model, jurisdiction, and consumer law before production use.

1. Definitions

  • “We”, “us”, “our”: the operating entity named in our Imprint.
  • “You”: the individual or legal entity using the Service.
  • “User content”: materials, text, images, links, job descriptions, applications, messages, and other content you submit or transmit via the Service.

2. The Service

Crea Services provides an online platform that connects creative freelancers with companies and facilitates related workflows (such as job postings, applications, collaboration, and associated tools). We may modify, suspend, or discontinue features with reasonable notice where practicable, or immediately where required for security, legal compliance, or operational reasons.

We do not guarantee uninterrupted or error-free operation. The Service is provided on an “as is” and “as available” basis to the extent permitted by law.

3. Eligibility and accounts

You must be at least the age of digital consent in your country (and in any event at least 16 years old) to use the Service. You agree to provide accurate registration information and to keep it up to date.

You are responsible for safeguarding your login credentials and for all activity under your account. Notify us promptly at hello@creaservices.com if you suspect unauthorised access.

We may refuse registration, suspend, or terminate accounts that violate these Terms, pose security risks, or misuse the Service.

4. Plans, fees, and payment

Certain features may require a paid subscription or fees as described on our Pricing page or in an order form. Prices, taxes, billing cycles, and renewal terms apply as stated at checkout or in your agreement. Payment is processed by third-party payment providers; their terms may also apply.

Unless stated otherwise, subscriptions renew automatically until cancelled in accordance with the cancellation process we provide. Statutory withdrawal rights for consumers (where applicable) remain unaffected — insert jurisdiction-specific information after legal review.

5. User content and licence

You retain ownership of your User content. You grant us a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, display, and distribute User content solely as necessary to operate, improve, and promote the Service (including technical processing such as backups and content delivery).

You represent that you have all rights necessary to grant the foregoing licence and that your User content does not infringe third-party rights or violate applicable law. We may remove or restrict content that violates these Terms or that we are required to remove by law.

6. Acceptable use

You agree not to:

  • use the Service for unlawful, fraudulent, or harmful purposes;
  • harass, discriminate against, or defame other users, or publish illegal, hateful, or sexually exploitative content;
  • scrape, crawl, or harvest data from the Service without permission, or circumvent technical limits or security measures;
  • upload malware, attempt unauthorised access to systems or accounts, or disrupt the Service;
  • impersonate others or misrepresent your affiliation or qualifications;
  • use the Service to send unsolicited bulk communications in violation of law.

7. Relationships between users

The Service helps users find and work with each other. Contracts for work, deliverables, payment between freelancers and companies, and dispute resolution regarding such engagements are primarily between those users. We are not a party to those agreements unless we explicitly state otherwise in writing.

We may offer tools (e.g. messaging, invoicing aids) for convenience; they do not constitute legal, tax, or employment advice.

8. Intellectual property

The Service, including software, design, trademarks, and branding (excluding your User content), is owned by us or our licensors. Except for the limited rights expressly granted in these Terms, no rights are granted to you.

9. Confidentiality

If you receive non-public information about us or other users through the Service, you must protect it and use it only for the purpose for which it was shared, unless you have consent or are legally required to disclose.

10. Disclaimer of warranties

To the fullest extent permitted by applicable law, we disclaim all warranties, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will meet your requirements or that results obtained through the Service will be accurate or reliable.

11. Limitation of liability

To the fullest extent permitted by applicable law, we and our affiliates, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, goodwill, or business opportunities, arising out of or related to your use of the Service.

Our aggregate liability for all claims arising out of or related to the Service shall not exceed the greater of (a) the amounts you paid us for the Service in the twelve (12) months before the claim, or (b) [insert statutory minimum / small cap if required in your jurisdiction — e.g. fifty euros], except where liability cannot be limited by law (including death or personal injury caused by negligence, fraud, or other non-waivable rights).

12. Indemnity

You will defend, indemnify, and hold harmless us and our affiliates from and against any claims, damages, losses, and expenses (including reasonable legal fees) arising from your User content, your use of the Service in breach of these Terms, or your violation of law or third-party rights — subject to any limitations mandatory for consumers in your jurisdiction.

13. Term and termination

These Terms apply from your first use of the Service until terminated. You may stop using the Service and request account closure according to our processes. We may suspend or terminate access for breach of these Terms, non-payment where applicable, or legal or operational necessity.

Provisions that by their nature should survive (e.g. licence grants to the extent needed to wind down, liability limits, indemnity where enforceable) will survive termination.

14. Governing law and venue

These Terms are governed by the laws of [insert jurisdiction — e.g. Germany, England and Wales], excluding conflict-of-law rules. Courts in [insert venue] shall have exclusive jurisdiction, subject to mandatory consumer protections requiring a different forum.

15. General

If any provision is invalid, the remainder remains in effect. Failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
